IRS Announcement KY-2024-03 Includes Kentucky Tax Relief


The Kentucky Department of Revenue (DOR) will honor the recently announced IRS tax relief for taxpayers in parts of Kentucky affected by severe storms, straight-line winds, tornadoes, landslides, and mudslides that began on May 21, 2024.  The tax relief postpones various tax filing and payment deadlines through February 3, 2025.  As a result, affected individuals and businesses with a deadline on or after May 21, 2024, will have until February 3, 2025, to file returns and pay any taxes that were originally due during this period. 

Under the provisions of KRS 131.081(11), Kentucky honors federal extensions related to disaster relief for filing of income tax returns, including payment of tax due. Individuals and households affected by severe storms, tornados and flooding who reside or have a business in Adair, Allen, Ballard, Barren, Bell, Breckenridge, Butler, Caldwell, Calloway, Carlisle, Christian, Clay, Clinton, Crittenden, Cumberland, Edmonson, Estill, Fulton, Garrard, Graves, Grayson, Green, Greenup, Harlan, Hart, Hickman, Hopkins, Jackson, Knox, Larue, Laurel, Lee, Leslie, Livingston, Logan, Lyon, Marshall, McCracken, McCreary, McLean, Meade, Menifee, Metcalfe, Monroe, Muhlenberg, Ohio, Owsley, Perry, Pulaski, Rockcastle, Russell, Simpson, Todd, Trigg, Warren, Washington, Wayne, Whitley, and Woodford counties qualify for this tax relief.

This extension allows affected taxpayers whose filing deadline is on or after May 21, 2024, until February 3, 2025, to file Kentucky income tax returns and submit tax payments for individual income tax, corporate income tax, pass through entity tax, income tax withholding, and limited liability entity tax. Late filing and payment penalties will be waived for those affected taxpayers seeking this relief. Kentucky's tax laws have no provision for the waiver of interest.

The February 3, 2025, filing deadline also applies to individuals who filed a valid extension to file their individual returns by October 15, 2024.  Payments of tax that were due on April 15, 2024, are excluded from this relief.

Kentucky Partnership and S Corporation returns with a valid extension through October 15, 2024, and Kentucky Corporation returns with a valid extension through November 15, 2024, also qualify for the extended filing relief through February 3, 2025.  Payments are not eligible for this relief.

The February 3, 2025, deadline applies to payments due on or after May 21, 2024, including quarterly estimated payments and Kentucky payroll payments.

Taxpayers are advised to label the top margin of the tax forms filed under this relief provision in large, red letters with the words "Kentucky Disaster Relief."
